Right2Homes Constitutional Challenge to Home Repossessions
WHO WE ARE
Right2Homes has been set up to provide a funding platform for the numerous individuals, groups and organisations already committed to supporting legal initiatives aimed at preventing bank repossessions of Irish family homes.
FAMILY HOMES UNDER SEIGE
Whether you are part of one of the 110,366 distressed families already under attack, or related to someone who is, or about to be, you now have an opportunity to support efforts to legally challenge the injustice of what is happening in Courts throughout the length and breadth of Ireland.
FIRST LEGAL INITIATIVE
Right2Homes is seeking to raise funds in support of the Constitutional Challenge, currently ‘in being’ (Supreme Court Record No. 2014/755P) Darcy -v- Minister of Justice, Equality & Law Reform and the Attorney General.
The Constitutional Challenge’s legal team informed Justice Finlay Geoghegan of the relevance of the Challenge in the Court of Appeal on June 5th. This challenges the retroactive nature of the Land & Conveyancing Law Reform Act 2013, hastily enacted by Government to circumvent the Justice Dunne ruling of 2009 which effectively prevented the banks from seeking possession of family homes.
THE BENEFIT TO YOU
The Challenge process, currently under way, will force Courts to take account of the unconstitutional aspects of the 2013 Act and demand also that they refrain from granting Possession Orders to banks until such time as this matter is finally determined in the Supreme Court. The action itself will also help highlight the unfairness and inequity of the processes currently being adopted in favour of bailed-out financial institutions at the expense of tens of thousands of distressed Irish family homeowners.
PLEASE SUPPORT
We are reaching out today to everybody involved in this financial nightmare (created in the first instance by banks and through poor governance) and also to those amongst us, at home and abroad, who care about the injustice and unfairness that is currently being perpetrated against our own people most of whom are unable to afford legal representation to defend their family homes in the face of such overwhelming force.
PLEASE SHARE
Attached you’ll find links to various sites where you’ll find more information and regular updates on progress with this initiative, the first of a number of legal challenges addressing the threat to family homes and farms. Remember it was never a crime to borrow money, the wrongdoing lies entirely with the financial institutions and the people elected to regulate them.
